1.Who we are
Ozark Helper ("Ozark Helper", "we", "us", or "our") provides controller accessibility software and related services through the website at [ozarkhelper.com]. These Terms of Service ("Terms") govern your access to and use of our website, software, and services (together, the "Service").
The Service is operated by [LEGAL ENTITY NAME / SOLE TRADER NAME], based in [CITY, Spain]. You can reach us at help@ozarkhelper.com.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2.Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from us. If you are under that age, you may use the Service only with the involvement and consent of a parent or guardian who agrees to these Terms.
3.Your licence
When you purchase a plan, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal use, in accordance with these Terms and the plan you purchased.
You may not:
- Share, resell, sublicense, rent, or redistribute your access, access code, or any part of the Service;
- Copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the software, except to the extent this restriction is prohibited by applicable law;
- Use the Service in any way that breaches these Terms or any applicable law.
4.Acceptable use
Ozark Helper is designed as an accessibility tool: it changes how your own inputs reach a game (remapping, toggles, and ignoring unintended stick drift). It does not aim for you, does not move your controls on your behalf, and does not automate in-game actions.
You are responsible for how you use the Service, including ensuring your use complies with the terms of service, rules, and codes of conduct of any game, platform, or service you use it with. Different games and platforms have their own policies about input devices and software, and those policies are between you and them. You agree not to use the Service to violate the rules of any third-party game or platform.
5.Purchases & access
Plans are sold as a one-time purchase. Prices are shown at checkout in the currency indicated and may include applicable taxes. Payment is processed by our third-party payment provider; we do not store your full card details.
After a successful purchase, you receive access to the corresponding features and any access code by email. It is your responsibility to keep your access code secure and to provide an accurate email address at checkout.
For information about refunds and the EU right of withdrawal, see our Refund Policy.
6.Updates
Plans described as including "lifetime updates" entitle you to updates we release for the version of the Service you purchased, for as long as we continue to operate and support that product. "Lifetime" refers to the lifetime of the product, not a guarantee of perpetual operation. We may change, add, or discontinue features over time.
7.Third-party tools
Applying a controller setup during play may require third-party software that is not provided or controlled by us (for example, Steam Input or other controller-remapping tools). Your use of any third-party tool is governed by that tool's own terms and policies. We are not responsible for third-party software, and we do not guarantee that any particular third-party tool will be available, compatible, or permitted with any given game or platform.
8.Intellectual property
The Service, including its software, design, text, graphics, and logos, is owned by us or our licensors and is protected by intellectual-property laws. Except for the licence granted in Section 3, nothing in these Terms transfers any rights to you.
9.Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, about the Service, including that it will be uninterrupted, error-free, compatible with your hardware or any specific game, or fit for a particular purpose.
Nothing in these Terms excludes or limits any rights you have under mandatory consumer-protection law, including under Spanish and EU law, which apply regardless of these Terms.
10.Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim.
These limits do not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.
11.Termination
We may suspend or terminate your access if you materially breach these Terms, including the acceptable-use and licence terms. You may stop using the Service at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and liability) will survive.
12.Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will take effect when posted; your continued use of the Service after changes means you accept them.
13.Governing law
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and nothing here deprives you of those protections.
